This Terms & Conditions Agreement (“Agreement”) is a legally binding contract between you (“User”) and Sikka (“Company,” “we,” “our,” “us”) governing your use of our mobile application (“App”) and related services, including gold trading, investment, custody, and payment processing.

By downloading, registering, or using the App, you confirm that you:

1. Have read and understood this Agreement
2. Accept and agree to be bound by these terms, conditions, and policies
3. Consent to the collection, processing, and use of your personal data as described herein
4. If you do not agree, do not use our Services

Eligibility

You must:

1. Be at least 18 years old
2. Be a Pakistani citizen or legally authorized resident in Pakistan
3. Hold a valid CNIC/NICOP
4. Complete KYC verification in compliance with State Bank of Pakistan (SBP) and Financial Monitoring Unit (FMU) regulations

Account Registration & Security

1. Provide accurate, complete, and current information during registration
2. Keep your login credentials secure and confidential
3. Immediately notify us if you suspect unauthorized access
4. You are fully responsible for all activity conducted under your account

Regulatory Compliance

You agree to comply with:

1. Anti-Money Laundering Act, 2010 (AMLA)
2. SBP regulations and FMU guidelines
3. Prevention of Electronic Crimes Act (PECA), 2016

We reserve the right to suspend or terminate accounts involved in suspicious activity and report such matters to competent authorities.

Services

1. Real-time digital gold trading at market rates
2. All trades are final and irreversible once confirmed
3. Transaction limits apply as per SBP directives
4. Physical gold delivery may be offered under separate terms, including applicable delivery, insurance, and handling charges

Payments & Withdrawals

1. Payments must be made through approved banking channels or authorized gateways
2. We are not responsible for bank/payment processor delays
3. Withdrawals may take 3–5 business days post-verification

Prohibited Activities

You must not:

1. Engage in money laundering, terrorist financing, or fraudulent transactions
2. Violate Pakistani law or SBP/FMU directives
3. Distribute malware, hack, or disrupt services

Risk Disclaimer

Gold prices fluctuate and may result in financial loss. We do not guarantee returns or profits. You are solely responsible for your investment decisions.

Cross-Border Data Transfers

If transferred outside Pakistan, data will be safeguarded and processed in compliance with applicable laws.

Custody & Insurance of Gold Holdings

All gold purchased via the App is held in secure, SBP-approved vaults under the Company’s name on behalf of clients, insured against theft and physical loss (excluding force majeure events). Periodic audit certificates are made available to clients.

Intellectual Property

All App content, trademarks, and software are our property. No reproduction, modification, or distribution without prior written consent.

Limitation of Liability

We are not liable for:

1. Losses from market price movements
2. Unauthorized access caused by your negligence
3. Failures of third-party systems or networks
4. Force majeure events (including cyberattacks beyond reasonable prevention)

Termination

We may suspend or close your account if you:

1. Breach this Agreement or applicable laws
2. Provide false information
3. Engage in prohibited activities

Governing Law & Dispute Resolution

This Agreement is governed by the laws of Pakistan. Disputes shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Amendments

We may update this Agreement with prior notice. Continued use after updates constitutes acceptance of the new terms.
